Port Jervis man convicted of rape

GOSHEN – An Orange County Court jury has convicted a 42-year-old Port Jervis man of two counts of rape in the third degree.

District Attorney Frank Phillips said Ruben Torres was found guilty of having sex with a woman in on two different occasions in May and June 2007.

"This is not a statutory rape nor is it a forcible rape. The law was amended several years ago to indicated where force was not used, the victim still had the right to say no and if she said that, the defendant could not proceed with having sexual intercourse,” he said.

When sentenced, Torres faces up to four years in prison in each count.
